1. About Our Terms
These Terms explain how you may use the Cleanifiq platform (the "Platform") which is available for download free of charge. They apply to the use of services provided by Cleanifiq Ltd, a company incorporated in Scotland under number SC684576 and having its registered office at 1119 Cathcart Road, Glasgow, G42 9BD ("we", "us" or "our") through the Platform.
Someone who uses the services available through the Platform (the "Services") is referred to as a "User", "you" or "your" and will be using the Services either as a Customer or as a Cleaner.
Important: By registering with the Platform as a Customer or otherwise indicating your consent, you agree to be bound by these Terms and the documents referred to in them.
2. Using the Platform
You agree that you are solely responsible for:
- All costs and expenses you may incur in relation to your use of the Platform; and
- Keeping your password and other account details confidential.
The Platform is intended for use only by those who can access it from within the UK. If you choose to access the Platform from locations outside the UK, you are responsible for compliance with local laws where they are applicable.
We may prevent or suspend your access to the Platform if you do not comply with any part of these Terms, any terms or policies to which they refer or any applicable law.
3. Our Role
The purpose of the Platform is to act as a means of allowing Customers to advertise their cleaning requirements (the "Task" or "Tasks") to Cleaners, to provide a platform to allow Cleaners to view the Tasks and to provide Customers with a means of selecting a Cleaner and engaging with them to carry out the Task.
Our role is limited to facilitating the Cleaner and the Customer agreeing terms upon which the Cleaner is appointed to carry out the Task. Other than accepting payment of the Charge on behalf of the Cleaner, we have no further role or responsibilities.
4. User Profile and Accounts
Users are responsible for all information they post or upload to the Platform, for the content of their Profiles and for their own security in connection with our services, both online and offline.
Users warrant and confirm that all content in their Profiles is accurate and not misleading and we reserve the right to suspend and/or terminate a User's profile if we consider any content to be inaccurate or misleading.
Users are responsible for all use made of their account. You should contact us immediately if you believe unauthorised use has been made of your account.
5. Disputes
Dispute Notice: You must notify us within 48 hours if you're unhappy with a cleaning service, or it will be considered accepted.
Where a dispute arises in relation to the performance of a Task, you will first give the Cleaner an opportunity to rectify the Task by completing the work again.
You must provide video or photographic evidence of any disputed work. Should you not provide such evidence, we reserve the right to close your dispute within 7 days.
6. Your Privacy and Personal Information
Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our privacy policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information.
7. Ownership and Intellectual Property
The Platform and all intellectual property rights in it are owned by us. This includes but is not limited to content, trade marks, domain names, design rights, database rights, patents and all other intellectual property rights.
Nothing in these Terms grants you any legal rights in the Platform other than as necessary to enable you to access the Platform.
8. Limitation on Our Liability
Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury) or arising under applicable laws relating to the protection of your personal information, we are not legally responsible for any losses that were not foreseeable or business losses.
9. Governing Law & Jurisdiction
These terms and conditions and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with Scottish law and the courts of Scotland shall have non-exclusive jurisdiction to settle any such dispute or claim.
